Terms of Service

1. Acceptance of Terms

By accessing or using TrackFolio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TrackFolio is a personal portfolio tracking tool that helps users track investments, calculate adjusted cost base (ACB), and generate tax reports. The Service is provided on a best-effort basis and is intended for informational and personal record-keeping purposes only.

TrackFolio is not a financial advisor, tax advisor, or licensed professional service. The calculations, reports, and data provided by TrackFolio are for informational purposes only and should not be relied upon as financial, tax, or investment advice. Always consult a qualified professional for financial and tax decisions.

3. Best-Effort Service

TrackFolio is provided "as is" and "as available" without warranties of any kind, whether express or implied. We make reasonable efforts to ensure the Service is available and functioning correctly, but we do not guarantee:

Uninterrupted or error-free operation of the Service
Accuracy, completeness, or timeliness of stock prices, exchange rates, or any financial data
Accuracy of ACB calculations, capital gains computations, or tax reports
Preservation or security of your data beyond reasonable commercial efforts

4. Limitation of Liability

To the maximum extent permitted by applicable law, the operators of TrackFolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, revenue, or anticipated savings
Loss of data or data corruption
Financial losses resulting from reliance on calculations, reports, or data provided by the Service
Tax penalties, incorrect filings, or any consequences arising from use of the Service's tax reporting features
Damages arising from service interruptions, downtime, or unavailability
Damages arising from unauthorized access to your account

In no event shall the total liability of the operators exceed the amount you have paid for the Service in the twelve (12) months preceding the claim, or $0 if the Service is provided free of charge.

5. Your Responsibilities

You are solely responsible for:

The accuracy of data you enter into TrackFolio
Verifying all calculations and reports before using them for tax filings or financial decisions
Maintaining the security of your account credentials
Maintaining your own backups of important financial data
Complying with all applicable laws and regulations in your jurisdiction

6. Data and Account Deletion

You may delete your account and all associated data at any time through the Settings page. Upon deletion, your data is permanently removed from active systems. Residual copies may exist in encrypted backups for up to 30 days. We reserve the right to terminate accounts that violate these terms or are inactive for an extended period, with reasonable notice where possible.

7. Intellectual Property

All content, design, code, and branding associated with TrackFolio are the property of the operators. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

8. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of TrackFolio after changes constitutes acceptance of the revised terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
